Description: The Fostering Independence Through Technology Act of 2013 directs the Secretary of Health and Human Services (HHS) to conduct pilot projects under title XVIII (Medicare) of the Social Security Act for the purpose of providing incentives to home health agencies to furnish remote patient monitoring services that reduce expenditures. The bill also directs the Secretary to specify the criteria for identifying Medicare beneficiaries within the scope of the pilot projects.  In addition, the bill directs the Secretary to establish for each participating home health agency a performance target using specified methodologies.

Description: The Mental Health Awareness and Improvement Act of 2013 reauthorizes various mental health programs run by the Departments of Health and Human Services (HHS) and Education related to mental health and substance use disorders, including school-based mental health programs. The amendment would renew programs on suicide prevention and funding for child trauma centers. It would allow funds to be used for educating students, families, faculty, and staff on how to respond to students with mental and substance use disorders. An amendment to the Safe Communities, Safe Schools Act of 2013 (s.649, the gun policy bill) also would amend the Public Health Service Act to authorize the appropriation of $105 million for each of fiscal years 2014 through 2018 for suicide prevention and mental health services.

Description: Consolidated and Further Continuing Appropriations Act, 2013Continuing resolution (CR) funding the government through September while adding appropriations and flexibility for certain agencies, without increasing overall funding. The new CR includes a $71 million increase for the National Institutes of Health and would require the administration to obligate all fiscal year 2013 funds appropriated for community health centers. The legislation retains the $85 billion in automatic spending cuts that took effect March 1st under the Budget Control Act, including the 2% reduction to providers’ Medicare payments.

Description: Preventing Greater Uncertainty in Labor-Management Relations Act requires the National Labor Relations Board (NLRB) to cease all activity that requires a quorum of Board members. Prohibits the Board from appointing any personnel nor implementing, administering, or enforcing any decision, rule, vote, or other action decided, undertaken, adopted, issued, or finalized on or after January 4, 2012, that requires a quorum of the Board members.  Terminates the requirements of this Act upon: (1) confirmation of all Board members constituting a quorum with the advice and consent of the Senate, (2) a decision by the Supreme Court on the constitutionality of Board appointments made in January 2012, or (3) the adjournment sine die of the first session of the 113th Congress.  Prohibits, in the event of this Act's termination, the appointment, or implementation, administration, or enforcement of any Board action occurring on or after January 4, 2012, that requires authorization by not less than a quorum of the Board members, unless and until the action is considered and acted upon by a Board constituting a quorum, or the Supreme Court issues a decision on the constitutionality of the Board appointments made in January 2012.

Description: Medicare Audit Improvement Act directs the Secretary of Health and Human Services (HHS) to establish a process which subjects to a single, combined maximum annual limit, applied incrementally, the number of additional documentation requests made to a hospital by Medicare administrative contractors, recovery audit contractors, or Comprehensive Error Rate Testing (CERT) program contractors pursuant to prepayment and postpayment audits requiring a hospital to submit a medical record for audit purposes.

Description: The Health Care Price Transparency Promotion Act of 2013 require states to have or establish laws requiring hospitals to disclose information on charges for certain inpatient and outpatient services; and require health insurers to provide to enrollees upon request a statement of estimated out-of-pocket costs for particular health care items and services. In addition, the legislation directs the Agency for Healthcare Research and Quality to study the types of health care cost information that consumers find useful, and how that information might be distributed in a timely and simple, coherent way.

Description: Working Families Flexibility Act amends the Fair Labor Standards Act of 1938 to authorize private employers to provide compensatory time off to private employees at a rate of 1 1/2 hours per hour of employment for which overtime compensation is required. Authorizes an employer to provide compensatory time only if it is in accordance with an applicable collective bargaining agreement or, in the absence of such an agreement, an agreement between the employer and employee.  Prohibits an employee from accruing more than 160 hours of compensatory time. Requires an employee's employer to provide monetary compensation, after the end of a calendar year, for any unused compensatory time off accrued during the preceding year.  Requires an employer to give employees 30-day notice before discontinuing compensatory time off.

Description: Animal Drug User Fee Amendments of 2013 increase the safety and security of the nation’s drug distribution system.  The bill would establish a lot-level tracing requirements for manufacturers, wholesale distributors, pharmacies and repackagers based on changes in ownership, and establish a collaborative process between the Food and Drug Administration and stakeholders to better understand how and when to move to unit-level traceability. FDA then must issue a proposed regulation on unit-level traceability in 2027.

Description: Cutting Costly Codes Act of 2013.  The bill prohibits the Secretary of the Department of Health and Human Services (HHS) from replacing ICD-9 with ICD-10 in implementing the HIPAA code set standards.  The bill also asks the Comptroller General of the United States, in consultation with stakeholders in the medical community, shall conduct a study of identify steps that can be taken to mitigate the disruption on health care providers resulting from a replacement of ICD-9 as such a standard.  The Comptroller General is then required to submit a report to each house of Congress on the study no later than 6 months after the date of the enactment of the bill.
